Practitioner Client Contract

ARTICLE 1 – INTRODUCTION OF THE PARTIES
This service agreement (hereinafter referred to as the "Contract") governs the contractual relationship between:

The parties are referred to individually as a "Party" or collectively as the "Parties."
ARTICLE 2 – PRELIMINARY DECLARATIONS OF THE PARTIES
The Client declares and guarantees to the Service Provider that they:

Are at least 18 years old and have the legal capacity to enter into this Contract (or are legally represented).

Are not pregnant and, to their knowledge, do not have any congenital or acquired illnesses, or if applicable, are under medical supervision.

Acknowledge having received all mandatory pre-contractual information as required by Articles L111-1 and L111-2 of the French Consumer Code.

Confirm being fully informed about the nature of the Services and that the Service Provider has answered all their questions.

ARTICLE 3 – NATURE OF THE CONTRACT AND SERVICE DESCRIPTION
This Contract is a service agreement governed by the French Consumer Code for consumer clients.
Services provided by the Service Provider:

Functional Naturopathy

Foot Reflexology
-
Iridology
Certifications and Diplomas Held by the Service Provider:

Certified Naturopath
-
University Diploma in Micronutrition
-
Foot Reflexology Certificate
These activities are considered “non-conventional” practices intended to relieve certain ailments or improve overall well-being and preventive health.
The Client acknowledges that these Services do not replace conventional medical diagnosis or treatment.
ARTICLE 4 – REMOTE OR IN-HOME CONTRACTS
When this Contract is concluded remotely (via our website, email, or booking platform) or at the Client’s home, the mandatory pre-contractual information (in accordance with Articles L221-5 and L221-10 of the French Consumer Code) has been provided to the Client.
The Service Provider will send a confirmation of the Contract on a durable medium (usually by email) within a reasonable time before the start of the Services.
Right of Withdrawal
The Client has a 14-day withdrawal period without justification, starting from the day after the digital acceptance of the Contract.
To exercise this right, the Client must notify their decision by email to jkalonji06@gmail.com before the deadline expires.
Note:

If the Client books an appointment before the withdrawal period expires and the Services are fully delivered, the right of withdrawal is considered waived.

For home Services, the Client accepts immediate execution upon Contract acceptance.

ARTICLE 5 – CONDITIONS FOR SERVICE DELIVERY
The dates and terms of Service execution are mutually agreed upon between the Service Provider and the Client.
The Service Provider may deliver Services digitally, ensuring security and confidentiality of personal data.
The Client agrees to actively cooperate and provide necessary information (including health conditions, pregnancy, vulnerabilities, disabilities).
The Service Provider commits to exercising due diligence in performing the Services and informing the Client of any issues.
ARTICLE 6 – CANCELLATION
Any cancellation by the Client after acceptance must be notified at least 48 hours before the scheduled Service date.
Beyond this period, payments are non-refundable (except in case of a valid withdrawal).
The Service Provider reserves the right to cancel or suspend Services if they prove incompatible or unsuitable for the Client’s condition, with a prorated refund for Services already provided.
ARTICLE 7 – PRICING AND PAYMENT
Service fees are determined by the Service Provider and displayed on the website.
Prices are exclusive of taxes and additional costs, unless stated otherwise.
The Client is informed that these fees are not reimbursed by social security.
Payment Terms:

Remote Services: Payment is required at the time of booking, confirming a firm order.

Out-of-office Services: The Client has 7 days after acceptance to make the payment, in accordance with legal provisions.
A detailed invoice or receipt will be issued upon Service completion.
ARTICLE 8 – CONTRACT DURATION
This Contract takes effect upon digital acceptance and remains valid for the entire duration of the Service execution (single or multiple sessions).
ARTICLE 9 – CONFIDENTIALITY
The Parties agree to maintain confidentiality regarding all exchanged information, except for publicly available or previously known data.
This obligation remains in effect for five (5) years after the end of the Contract.
ARTICLE 10 – LIABILITY
The Service Provider is responsible for proper execution of the Contract, except in cases of force majeure or Client fault.
Liability is limited to a maximum of €2,000 for direct damages (unless proven negligence).
Indirect damages (loss of opportunity, data loss, etc.) are excluded.
ARTICLE 11 – FORCE MAJEURE
Neither Party shall be held liable for events beyond their reasonable control.
The affected Party must notify the other Party by registered letter as soon as possible.
If force majeure persists beyond 15 days, the Contract may be terminated automatically.
ARTICLE 12 – PERSONAL DATA
The Client’s personal data, necessary for Service provision, is processed in compliance with French Law No. 78-17 and GDPR (Regulation No. 2016/679).
The Client acknowledges having read and accepted the data processing policy.
ARTICLE 13 – EVIDENCE AGREEMENT
Electronic exchanges and records related to this Contract have the same probative value as a manually signed document.
The Service Provider’s stored files will serve as legal proof of facts.
ARTICLE 14 – MISCELLANEOUS PROVISIONS
Each clause shall be interpreted to remain in compliance with applicable law.
If a clause is deemed illegal or unenforceable, it will be replaced by an equivalent provision negotiated in good faith.
Failure to enforce a right does not constitute a waiver of that right.
ARTICLE 15 – TERMINATION FOR BREACH
In case of a fundamental breach by either Party, the Contract may be terminated 15 days after a formal notice remains unanswered, sent by registered letter with acknowledgment of receipt, without prejudice to any damages.
ARTICLE 16 – APPLICABLE LAW AND JURISDICTION
This Contract is governed by French law.
In case of unresolved disputes, the competent court shall be the one of the defendant’s place of residence.

The Client’s name, surname, and signature date will be automatically recorded upon digital acceptance.
